CBD and Hemp Laws in Virginia: August 2026 Update

Virginia’s retail hemp-product rule changes on August 15, 2026. Through August 14, a statutory 25:1 CBD-to-THC exception can apply within the existing total-THC framework. Beginning August 15, that exception is repealed. Do not use a pre-change guide to evaluate inventory after the effective date.

Rule through August 14, 2026

Before the change takes effect, Virginia’s retail framework generally limits a hemp product to no more than 0.3 percent total THC and no more than two milligrams of total THC per package, unless the product satisfies the statutory 25:1 CBD-to-THC ratio exception. The exact definitions and product requirements in the Virginia Code still control.

Rule beginning August 15, 2026

Effective August 15, the 25:1 exception is repealed. Virginia’s official hemp guidance says hemp products produced or sold in the Commonwealth must be at or below 0.3 percent total THC and contain no more than two milligrams total THC per package. The state has not provided a general sell-through grace period for products that relied on the former ratio exception.

Retail oversight is moving to the Virginia Cannabis Control Authority. Businesses and shoppers should use current CCA and Virginia Department of Agriculture and Consumer Services materials during the transition.

What “total THC” and “per package” mean for shoppers

Do not evaluate the product from a CBD headline alone. Match the exact package to the batch report and review the total-THC calculation, concentration, total amount in the package, serving information, and any current labeling requirements. A compliant concentration does not override a package-level limit.
